FALSEHOOD AND CALUMNY.--The undersigned having
been infamously and villainously belied by persons who
are engaged in manufacturing an article which they call
Mineral Water, by stating that the subscriber, during
the last summer, was engaged in Albany and elsewhere in
lecturing on Temperance and traducing the character of
respect hotel keepers in this city; deeming it a duty
due to those individuals, to truth, and to myself to
state explicitly that the assertion is false, and
founded only on that disgustful and despicable
principle, ENVY--(excited by my having received the
Silver Medal for the best Mineral Water with Syrups from
the American Institute last month)--concocted by means,
dastardly rascals, who I challenge to come forth in
their proper names and substantiate their most
disgraceful, villainous and lying assertions.

N. B.--My great desire to excel in the manufacture of
Mineral Waters with Syrup, and to supply my numerous
customers with a superior article, alone prevented my
waiting on them frequently, and which I hope will be
accepted as a sufficient apology for my seeming neglect.
TO HOTEL KEEPERS AND OTHERS.
Seeing an advertisement in several of the city papers, signed by A. W.
Rapp, 95 Third avenue, in which persons engaged in the
manufacture of Mineral Water, are traduced as " Mean,
dastardly rascals," &c., &c. We, as one of those
manufacturers of an article, which we, as also the
judges at the American Institute, not only call, but
know it to be Mineral Water, feel called upon to
vindicate ourselves and state a few facts. In
1843, we were among the first to commence the
manufacture and introduction of Mineral Water in this
city; the same year we received from the American
Institute a diploma--In 1844, from the same institution
a silver medal, for the best Mineral Water, in
opposition to A. W. Rapp and others. In 1845,
their last fair, we did not offer any competition,
withdrawing from the field for the reason, that we had
received two testimonials from that institution, and,
and also willing that others should have the benefit in
common with ourselves.
In answer
to the charge, that he, (A. W. R.,) lectured in Albany
last summer, on temperance, (if said charge is intended
for us,) we most positively deny that we have uttered
anything of the kind. To the charge that he, (A.
W. R.,) had traduced the character of respectable Hotel
Keepers because they sold liquor, we did assert the
above and do so now. We furthermore assert that he
gives or hires the third story of his premises, 95 Third
avenue, to the Mount Vernon Division of the Sons of
Temperance as a place of meeting--was last summer a
member of the said Society, and that he signed a
petition to the legislature last winter to deprive hotel
keepers of their licenses for proof read the affidavits
below; and yet this Adam W. Rapp, of 95 Third avenue,
has the audacity to ask support of the very men he
traduces--a class of our citizens who are engaged in a
legal business, by which they earn a livelihood for
themselves and families and whose characters for honesty
and truth will compare with that of Adam W. Rapp, or any
other man.
We have no envy or jealousy of A. W. Rapp, or any other man in the
business, relying upon our exertions, the superiority of
our articles and a generous public support. We
have no desire for a newspaper controversy, and are
determined, for the mighty principal of truth and right,
not to submit tamely to scurrilous and unwarrantable
attacks from anyone.
City and County of New York, ss:--Ebenezer S. Marshall,
s. shall having been duly sworn, deposeth:--That he has
heard A. W. Rapp, of 95 3rd avenue, say, that a man who
sells liquor is a thief, a liar, and a vagabond; that he
did not believe any honest man would engage in the
business, and would not believe him under oath.
Also, that in the presence of tis deponent, he signed a
petition to the legislature at Albany last winter,
asking them to discontinue the granting of license for
the sale of liquor in this city.

MINERAL WATER.
THE undersigned having seen an advertisement in the
papers, headed Falsehood and Calumny, and signed A. W. Rapp,
95 Third avenue, claiming the premium from the American
Institute, at their last fair, for the best Mineral water,
with the syrups, deem it a duty, in justice to their
numerous customers, the public, and themselves, to state
that the statement here put forth by Mr. A. W. Rapp, is by
no means correct, as may be seen by the records of the
American Institute, as also published in the N. Y. Tribute,
of Oct. 27, 1845.

So far as the language used by Mr. A. W. Rapp, of having been infamously
and villainously belied, by persons who are engaged in
manufacturing an article which they call Mineral Water, we
have nothing to say; or who he means by those assertions, we
are at a loss to understand; but the article we manufacture,
we, and the American Institute, call Mineral Water, for
which, in reference above, they have been pleased to award
us, as a premium, a silver medal; and he, Mr. A. W. Rapp,
with all his foreign information and retirement, to excel
others, and the instructions by a celebrated manufacturer in
Philadelphia, has succeeded, after three successive years,
two of which in opposition to ourselves and others, in
obtaining a premium for the second best of an article which
he call Mineral Water.
