Franklin J. Hoffman, who had been convicted at last court for selling porter in Phoenixville, was sentenced to pay a fine of $50 dollars and the costs of prosecution.  Defendant had sold the liquor under the advice of counsel, who thought he was excepted by the Bottler's act, from being prohibited from selling.  The court held against the counsel and a decision of the Supreme Court, has since been made, sustaining the ruling of our Court.  The Court regretted that the sentence in this case was so heavy, as the defendant had not acted with a disputation to violate the law, but they imposed the lightest sentence the law allowed.
